Gerichte behandeln Transsexualität als eine einer Krankheit vergleichbare Disposition. Behandlungen, die direkt zur Geschlechtsangleichung gehören, gelten deshalb als Krankheitskosten (Finanzgericht München, 10 K 1088/03). Courts treat transsexuality as a disposition comparable to an illness. Treatments that belong directly to gender transition therefore count as medical expenses (tax court Finanzgericht München, ruling 10 K 1088/03).
Dazu zählt die Haarentfernung im Zuge der Angleichung, am eindeutigsten im Gesicht und Bartbereich. This includes hair removal as part of the transition, most clearly on the face and beard area.
